Cisco in legal battle for infringement of Patent

Mosaid Technologies an Intellectual Property Licensor is attempting to stop the importation and sale of some of Ciscos products in the United States of America. Mosaid is claiming that Cisco?s Power over Ethernet (PoE) switches and routers, PoE IP Phones, VOIP cable Modems and other products infringe six of its patents. The Canadian company has filed its complaint against Cisco at the International Trade Commission (ITC).
Mosaid released a statement stating that they filed the complaint because they believed that Cisco is infringing Mosaid?s patents and that they are determined to protect their intellectual property rights.
This is not the first time that Mosaid and Cisco have been involved in a legal dispute. The two Companies are already embroiled in litigation over some of Mosaid?s Patent in the United States District Court of Delaware, which was filed by Cisco last year. Interestingly, the six patents were also in consideration in the Delaware case.
Mosaid is based in Ontario, Canada and is a renowned patent owner and licensor of inventions relating to communications system patents and is also actively involved in developing semiconductors.
Previously, Cisco had been ordered to pay $112,000,000 to Network 1 Security Solutions last year in a Power over Ethernet (PoE) infringement case.
Summary: Mosaid Technologies, a Canadian based intellectual property licensor, has sued American giant Cisco for patent infringement. The two companies were already litigating, over some of Mosaid?s patents. Now, Mosaid, has filed a complaint at the International Trade Commission (ITC) to stop the importation and sale of some of Ciscos Products into the United States of America.

Tourism rebounds on violence-marred border lake (AP)

ZAPATA, Texas ? Coy Callison doesn't believe he's risking his life when he steers his speedboat into crystal-clear waters that straddle the Texas-Mexico border, hoping to hook a few monster bass in an area marred with drug violence.

His marriage might be a different story.

"My wife threw a fit with us coming down here, but the fishing's been so fantastic," said Callison, a Texas Tech University communications professor, as he loaded his boat into Falcon Lake just after dawn. "I'm almost getting a divorce, basically."

Anglers are again descending in droves on the dammed section of the Rio Grande where American jet-skier David Hartley was presumably chased and gunned down by Mexican pirates last fall ? and where shootouts between Mexican soldiers and reputed drug runners have become frighteningly common in the eight months since.

Tourism plummeted after Hartley's Sept. 30 death, devastating Zapata and other shoreline Texas towns. But business has rebounded since January and only gotten stronger as a drought has given visitors access to once hard-to-reach shore areas teeming with bass, tilapia and other fish.

Falcon Lake borders portions of Mexico's Tamaulipas state, which is engulfed by a turf battle between the Gulf Cartel and the Zeta drug gang, both of which are fighting the Mexican military.

On May 8, Mexican marines patrolling their country's side of the lake discovered a staging area for smuggling marijuana into Texas by speedboat on a spit of land that becomes an island when the water is high. A gun battle ensued, killing one marine and 12 alleged Zeta gang members.

Many locals say such incidents are all too common since the Mexican navy recently stepped up patrols on its side of Falcon Lake. Zapata County Sheriff Sigifredo Gonzalez ticked off examples from that same week that weren't widely covered in the media, including a heavy gunfire battle on May 12 and a Mexican helicopter that shot a drug suspect three days later.

Those shootouts and Hartley's slaying were in Mexican waters, and violence so far has been contained to that country's side of bluish-green waters stretching 25 miles long and 3 miles across. But many fishing fanatics are heading to Mexico's part of the lake, anyway, saying the chance to reel in bass that grow larger than 10 feet outweighs fears about a drug war that has killed more than 34,000 people in Mexico since 2006.

"Everyone says, `Just stay out of Mexico.' But we go over there anyway, and it's no problem," said Levi Messer, a 26-year-old who recently drove 6.5 hours to hit Falcon Lake. "You might see a few less people than before, but there's still lots."

A stone's throw from Zapata's municipal boat ramp is a sign with red-and black-lettering proclaiming: "Warning: Crossing into Mexico Could Be Dangerous." Nearby, a smaller sign reminds boaters to report all suspicious activity, this one bearing the seals of the Texas attorney general's office and the U.S. Border Patrol.

Gonzalez erected both signs two months ago. "People can ignore them if they want," he said. "But we could potentially have a situation where someone goes to Mexico to fish and has a problem, and we can't go get them."

Hartley's wife Tiffany said her husband was shot in the head by Mexican pirates after the couple jet-skied past buoys marking the end of U.S. territory to visit a historic Mexican church. His body hasn't been recovered.

In the wake of that shooting, a national fishing tournament scrapped plans to come and two longtime fishing guides quit due to lack of business. Another guide, Jim Edwards, said of the 17 trips he had scheduled for last October, all but five canceled, and three of those only went ahead after he agreed to stay in Texas waters. Things got worse as the year drew to a close.

Paco Mendoza, president of the Zapata County Chamber of Commerce, said that while tourism has yet to fully recover, hotel occupancy rates for weekends, when Falcon Lake attracts the most anglers, are now up 30 to 40 percent since the doldrums following Hartley's shooting.

"A lot of people don't really realize how safe it is here until they actually come and see for themselves," Mendoza said. "We're working toward having our image repaired, but it's a slow process."

Edwards has recently fished within sight of the church the Hartleys were visiting. "The fishing is better than it ever has been," he said. "And that's bringing people back."

The owner of another guide service, Jim Behnken, said that since February, he's only had two days where he wasn't fully booked. He was with visitors from Kansas, fishing in Mexican territory the morning of Hartley's shooting. The outing went so well the group headed back to Mexican waters that same evening ? despite what had happened.

"It's a very big lake, and if you don't go looking for trouble, you won't find it," Behnken said.

Speedy Collett is a lodge-owner and guide who had a brush with Mexican pirates even before Hartley's slaying. In April 2010, he was guiding anglers who were approached by armed men after they went ashore on the Mexican side of Falcon Lake to take pictures. The assailants took the memory card from the digital camera of one visitor and checked Collett's phone to ensure he hadn't called anyone running drugs in the area.

"When they figured out we weren't a threat, they let us go," he said. "They told us `go fish and mind your own business.'"

That's what Collett's been doing ever since, and he said his lodge and guide schedule are full again.

"We're in recovery, but it's fragile," he said. "And if something else happens, we're dead."

Wall Street Rallies On Upbeat Data, Ford (NYSE: F) Jumps

US stocks finished higher on Tuesday as better-than-expected economic data bolstered investor sentiment.

The Dow Jones Industrial Average rallied 123.14 points, or 1.03%, to finish at 12,076.11. The S&P 500 jumped 16.04 points, or 1.26%, to close at 1,287.87. The Nasdaq Composite surged 39.03 points, or 1.48%, to 2,678.72.

The Commerce Department said Tuesday that retail sales slipped 0.2% in May. Economists had expected retail sales to drop 0.5% last month.

Meanwhile, the Labor Department said that producer price index increased 0.2% in May, slightly better than the 0.1% that economists had forecast.

On the earnings front, Best Buy Co. (NYSE: BBY) reported Tuesday that its fiscal first-quarter profit dropped to $136 million, or 35 cents a share, from $155 million, or 36 cents, in the prior-year quarter. Revenue rose 1.4% to $10.9 billion $10.79 billion. Analysts, on average, expected the company to report earnings of 33 cents per share on revenue of $10.69 billion. ?

J. C. Penney Company, Inc. (NYSE: JCP) soared more than 17% after the department store operator named Apple retail executive Ron Johnson as its next chief executive officer, succeeding Mike Ullman in that role.?

Shares of Ford Motor Co. (NYSE: F) rallied 29 cents, or 2.21%, to close at $13.43.?

European stocks closed higher. The UK FTSE rose 29.67 points, or 0.51% to 5,803.13. The German DAX and French CAC increased 1.69% and 1.50% respectively.

Asian stocks finished mixed. The Nikkei 225 climbed 99.58 points, or 1.05%, to 9,547.79. The Hang Seng index of Hong Kong fell 12.08 points, or 0.05%, to 22,496.

Chelsea's chief executive said on Wednesday the English Premier League club would name a new coach within two weeks.

Kuala Lumpur ? Chelsea's chief executive said on Wednesday the English Premier League club would name a new coach within two weeks and was looking to buy at least two players ahead of the new season.

Ron Gourlay said the team were close to announcing a new manager following the sacking of Carlo Ancelotti after the club's poor performance last season.

?The process is moving along very well... We would look to have a new coach in place maybe within a week, two weeks,? Gourlay told reporters in Kuala Lumpur.

?We are certainly working to a week, two weeks. But it could be sooner,? he said.

Blues captain John Terry has backed former Chelsea striker Mark Hughes or Turkey coach Guus Hiddink to take charge at Stamford Bridge.

But Gourlay, in Kuala Lumpur to launch a football training programme ahead of the Blues' visit next month, would not reveal who was in the running.

He said the squad, including a new manager and several more new players, would be unveiled when the Blues play their friendly against Malaysia's national side on July 21.

?I'm delighted to tell you that we will bring our full squad,? Gourlay said, but remained equally tightlipped on the club's transfer targets.

?I think we are looking at probably two to three players minimum coming into this side,? he said.

?It's just making sure we can get the right players available who can strengthen the team. Because we are a very, very strong team,? he said. ?We are in good shape. There is not too much meddling with the team to be done.?

On speculation that the team could let go of Didier Drogba, Gourlay said as far as he knew the Ivorian would be staying.

?Didier is very much a mainstay of the Chelsea team so yes, Didier will be here with us in a few weeks' time,? he said.

Chelsea have already signed on three players so far this year to strengthen the team to prepare for what is ?undoubtedly going to be a very, very difficult season ahead?, Gourlay said.

?Our target is very much to be back competing. Last year was a difficult year of course,? he said.

?However that's history now. We will move on. We expect to be competing for all the major trophies next season.?

?Let's not get too despondent. I'm sure a club like ours will bounce back very, very strongly this coming season,? he added.

The Malaysia stop will mark the Blues' third visit to this Southeast Asian country since 2003. As part of its Asia Tour, the team will also play in Bangkok on July 24 and Hong Kong on July 27 and 30.

S.Lanka face struggle to save England cricket series (AFP)

SOUTHAMPTON, England (AFP) ? If Sri Lanka manage a series-equalling victory in the third and final Test against England at the Rose Bowl, it will be one of their most impressive wins of recent times.

And it would certainly go a long way in helping interim coach Stuart Law, the former Australia batsman, get the job on a permanent basis.

An attack missing retired greats Muttiah Muralitharan and Chaminda Vaas, both now playing for English counties, as well as Lasith Malinga, has taken just 21 wickets in two Tests.

Meanwhile Sri Lanka head into the series finale, which starts on Thursday, without captain and in-form opening batsman Tillakaratne Dilshan, who had his thumb broken by England quick Chris Tremlett while making a superb 193 in the drawn second Test at Lord's.

Sri Lanka then had to persuade Kumar Sangakkara, Dilshan's immediate predecessor as skipper, to take up the reins again for what will be the first Test ever staged at the Rose Bowl, the home of southern county Hampshire.

"When he undertook this tour Kumar wasn't officially appointed as vice-captain," explained Sri Lanka team manager Anura Tennakoon

"But in case Dilshan had to come off the field, Kumar would stand in as the captain.

"That didn't mean he was going to captain a Test match from the start.

"Because of Dilshan's injury and being unable to play in the third Test, a situation arose that Kumar had to captain from the start -- which, I think, he wasn't really mentally prepared to do.

"But after some talking to him, that it was necessary for him to stand in, Kumar gave it some deep thought and tried to help the side by accepting that responsibility."

The uncapped Lahiru Thirimanne, who made a century in last week's drawn warm-up match against Essex, is set to take Dilshan's place in the team.

There was a time, following its debut as a first-class ground in 2001, where teams would have fancied their chances of taking 20 wickets so bowler-friendly was the Rose Bowl.

But the pitch has become progressively better to bat on and, while a five-day match has never been staged there before, all the indications are it will not deteriorate greatly.

In short, it looks like being another tough match for the bowlers, including Ashes star James Anderson, set to return after a side injury to lead an England attack that faltered in his absence at Lord's.

"It's going to be hard for us to get 20 wickets here, especially if the wicket is going to be as flat as it looks," Anderson said.

"To be honest in Test cricket at the moment a lot of the pitches are flat and it's something we've had to learn to deal with."

Steven Finn looks like being the man to make way for Anderson although Stuart Broad, for all his attractive lower order batting, will be aware a Test bowling average of nearly 36 could do with coming down soon.

Much of England's recent success has been built on the runs flowing from the bat of opener Alastair Cook, whose century at Lord's followed on from his hundred in the innings and 14-run first Test win in Cardiff.

A first innings score of fifty at the Rose Bowl would see him equal the England record of six in a row -- two in the match would give him a share of a world record held by a group including England coach Andy Flower.

Victory would see England go joint-second in the ICC Test rankings, alongside South Africa, with only India, their next opponents this English season, above them.

Oxygen's Glee Project What Did You Think

For months we've been hearing about Oxygen's The Glee Project -- a reality show orchestrated by Glee creator Ryan Murphy. The premise: forty-thousand people auditioned for 12 spots on a televised talent competition. If they made it, they'd get to participate in various challenges to win a seven-episode, guest-starring role on Glee.

On Sunday night's premiere episode, we got to meet the 12 wide-eyed, eager beavers who got that chance. All great singers, the contestants appeared to have been hand picked to fit some sort of high school social category. There was an overweight girl, a too-short guy with braces, a flirty Latina, a dreadlocked hippie type, an 18-year-old girl who looked 10, a gay-seeming guy, etc. They had one thing in common, though: They were bursting with jaw-dropping enthusiasm -- and soaring emotions.

They covered their mouths in shock when told that each week, a different Glee cast member would be dropping by to help out. (Darren Criss appeared in the premiere.) They cheered and leapt in the air when they heard what famous artists their video director had worked with prior to them. They bubbled over with predictions about what characters they'd play on Glee.

In other words, the overall vibe of the proceedings was very Glee-like. In many ways, the heart of Glee is arguably Rachel Berry (Lea Michele), a central character who wears her naïve exuberance on her sleeve. And when things don't go her way, she's excessively, whole-heartedly crushed. That's also what happens here.

As soon as the going gets tough, the show's emotional pendulum swings the other way. As people make mistakes, the tension rises exponentially. At one point, Glee's choreographer, Zach Woodlee, tells them he doesn't have time to treat them like three-year-olds. The young-looking girl is chided for acting too young. The skinny, hipster kid is criticized for fading into the background. The hunky pretty boy annoys everyone by pushing his own opinions on the video director.

If you tend to be carried away by the high-stakes drama of TV competitions, get excited: this show will surely take you on an emotional rollercoaster!

Hero Complex 2011 Recap

For the past few days at the Chinese Theater in Hollywood, Geoff Boucher of The Los Angeles Times hosted the second annual Hero Complex Film Festival.? In attendance were Warren Beatty for Dick Tracy, director Nicholas Meyer for Star Trek II: The Wrath of Kahn, writers/producers Alex Kurtzman, Roberto Orci and Damon Lindelof for Star Trek (2009), Richard Donner for Superman and Superman II (with an appearance by Geoff Johns), Jon Favreau and Robert Downey Jr. (who was a surprise guest) for Iron Man and Iron Man 2.? Of course they both talked a bit about Iron Man 3, The Avengers and Magic Kingdom.

In addition to the previously announced guests, Captain America: The First Avenger screenwriters Christopher Markus and Stephen McFeely premiered the new trailer and talked about the movie, and Mike Mignola talked about going back to Hellboy.? For more on the Festival, hit the jump.

avengers-promo-poster-01While I could have easily listed everything that was talked about, I decided to write up a summary and provide the audio.? So if you wanted to attend the Festival but couldn?t make it, hopefully this is the next best thing.

And for those wondering what Downey Jr. said about The Avengers, he was asked how it?s been going:

?Well, I hate everybody. ?I?m not talking about the cast and I?m not talking about Joss. What I mean is and Jon you can probably attest to this?I tend to look at a scene and say ?This is absolutely impossible, we can?t shoot this, it?s horrible.? I can tell you ten other movies its been in.? I refuse.? I usually start off the morning by refusing to do what I?ve signed on to do.? So I brought that attitude, happily. Anyway, I just thought how are you going to put all us clowns together? He?s wearing a suit.? He?s all jacked up.? He?s so and so.? And poor Mark Ruffalo, what he?s gonna out do us? And we?re about six weeks in and I have to say Joss Whedon is nailing it.? He?s so smart and so good. ?It?s going to be great.? I can?t believe I just said it, I never could?ve believed it but it?s gonna be great.?

Night 1: Warren Beatty for Dick Tracy

While I?ve been in Hollywood for many years, this was my first time getting to see Beatty talk and it was a great night.? I?d seen Dick Tracy years ago and thought it was decent, but after seeing it on the big screen again, I?ve got a whole new appreciation for the film and think it?s pretty great.

During the Q&A, Beatty mentioned he?s doing a sequel but he didn?t want to talk about specifics.? While I?d love to see it, I don?t think the film is ever going to happen.? But I?d love to be proven wrong.

If you listen to the audio, you can hear Beatty talk about:

  • How making a movie is like vomiting.? He feels better after he does it.
  • Tells a great story about how Pacino got cast. Also how Dustin Hoffman got cast.

  • After the movie came out Katzenberg wanted a sequel but Beatty was doing Bugsy
  • How he decided to use primary colors to tell the story
  • Admits to being obsessive compulsive
  • Doesn?t like the behind the scenes features on DVDs
  • How he didn?t do any press for Red and how he recently spoke to Terrence Malick.
  • Wouldn?t want to be a critic. Says it either hits you or it doesn?t.
  • Talked about Heaven Can?t Wait and his collaborative process
  • How a Dick Tracy Blu-ray is coming
  • I asked about 3D. He answered by talking about the need for variable ticket pricing
  • Told a great behind the scenes story about Ishtar.? One of the highlights of the night.

In addition to traveling the world to stalk the catwalks and shoot the campaigns, top model Anja Rubik also enjoys enviable access to the fashion world?s best designers?including her friend, Emilio Pucci creative director Peter Dundas. When Rubik?s boyfriend, Sasha Knezevic, popped the question last year, Rubik and Dundas put their heads together to design the perfect wedding dress. The bride refuses to share details, sketches, or shots of the design before the wedding next month?bad luck, after all?but the duo checked in with Style.com about the design process, the product, and a few favorite runway (not runaway) brides.

When did you two meet?
Anja Rubik: We met many years ago when Peter was still at Cavalli.

Peter, you cast Anja frequently in your shows. What does she bring to the catwalk?
Peter Dundas: I have used Anja in shows since I designed for Ungaro. She is one of my absolute favorite models?a perfect mix of beautiful, sexy, and rock ?n? roll. She is also someone extremely friendly and fun to hang out with so it was natural for me to choose her whenever I had official events with a Pucci Girl.

And Anja, why did you ask Peter in particular to design your wedding gown?
AR: Peter is an excellent designer; he makes women look beautiful, sexy, and cool! He understands a woman?s body and underlines what?s best in it. I asked him to do my dress because l love his rock ?n? roll chic, bohemian style. He is also a great guy to hang out with, so my dress fittings are fun!

Did you have an idea of the design you wanted when you started?
AR: I asked Peter to design the dress based on a few of his previous looks that I loved, then he sketched a couple designs and we tweaked them together and added a few new ideas. We have a meeting next week to fit and choose the final lace.
PD: It?s funny, because we both had the same silhouette in mind. I have to say that it?s been surprising what a sharp eye she has. I may have to keep her as an assistant after this.

Peter, how do you think about a wedding dress differently from one destined for the red carpet?
PD: I think with a wedding dress it?s all about the bride, whereas for a classic red-carpet moment I channel her inner Pucci Girl. A wedding dress should reflect the wearer?s personality, make her the absolute best-looking she can be. Either way, in Pucci she should feel like the only girl in the world.

Do you have any favorite wedding dresses?
PD: My absolute favorite wedding dress is Bianca Jagger?s white skirtsuit?a real rock ?n? roll moment. I have to say, my mom looked pretty amazing, too.
