Ask Asa: Dealing With The Student Loan Debt Crisis

(credit: MANDEL NGAN/AFP/GettyImages)

NEW YORK (CBSNewYork) ? Some say we?re on the brink of a new financial crisis ? one that revolves around staggering student loan debt.

Congress just voted against a scheduled interest rate hike on such loans, but millions of people ? many ready for retirement ? are still drowning in this debt.

Frank Freeman, 63, hasn?t taken a college course in nearly 40 years, but he?s still paying off an $80,000 student loan.

He didn?t use the money, but rather it was for his son?s college education. Because he co-signed the loan, he is now equally responsible for the debt. It?s not exactly what he had planned for his golden years.

?I thought I?d be retired, but I don?t see me retiring in the near future because of that,? Freeman said. ?If I have to keep working, I?ll keep working.?

Freeman is one of millions of 60-somethings still burdened by outstanding student loans.

Congress has passed legislation forestalling a sharp increase in interest rates on college loans, but many experts believe the student loan crisis ? especially among older Americans ? is reaching a breaking point.

?We have students, former students across the United States, who are really in a strangle hold,? said estate planner Ann Margaret Carrozza.

Carrozza said there are things you can do now to help pay it down.

?It?s imperative that someone who is having a little difficulty meeting their obligations contact the lender,? she said.

CBS 2?s Asa Aarons suggests people talk to their lender, adding they may be surprised at how willing they are to negotiate a better rate or new payment plan.

Carrozza also recommends consolidating your debt and ? in some cases ? it may make sense to refinance, take out a home equity loan or even mortgage a home that?s already paid off.

?It?s very important to get the word out and really research your options,? she said.

Not all 60-somethings are paying back their children?s loans. Many are paying back their own, having gone back to school later in life.

There is no time limit or statute of limitations on federal student loan collections, so government will seize portions of Social Security payments.

California man admits Babe Ruth glove is a fake, faces 20 years

A California man has pleaded guilty in a New York court to trying to sell for $200,000 a 19th-century baseball glove he falsely claimed belonged to Babe Ruth.

Irving Scheib entered the plea to a count of wire fraud in federal court in Manhattan on Thursday.

The government says the Bonsall, Calif., resident bought the glove on eBay for $750 in January. It says he then claimed the late "Father Knows Best" actor Robert Young had gotten the glove.

The government says Scheib is married to one of the actor's granddaughters.

Prosecutors say a buyer backed out after Scheib refused to notarize a letter. They say Scheib was caught after an investigator posed as a New York buyer.

The 50-year-old Scheib faces up to 20 years in prison on Oct. 30.

Activist's death highlights 'cruelty' of 'fitness for work' rules ...

Anti-cuts campaigners have paid tribute to a disabled activist who died last week after fighting for two years against the injustice of the government?s ?fitness for work? assessment regime.

Karen Sherlock died on 8 June, just a fortnight after she was told that she would be eligible once again to receive out-of-work disability benefits.

Campaigners say her death is further evidence that the much-criticised work capability assessment (WCA) is unfit for purpose and is causing thousands of disabled people anxiety and hardship, is exacerbating their ill-health and even contributing to some deaths.

Sherlock had several long-term health conditions, including diabetes and a heart condition, was about to start dialysis and was awaiting a kidney transplant, and experienced regular pain, exhaustion, vomiting and incontinence.

In a blog written in April, she described how her employment and support allowance (ESA) had been stopped, and accused the government of ?stripping the most vulnerable of the essential benefits they need?.

She added: ?Just throw them on the scrapheap. Don?t worry if they can?t feed themselves or heat their homes, or pay for taxis to take them places because they cannot walk anywhere.? No, that doesn?t matter, they are leeches on society.?

Sherlock had been forced out of her NHS job in 2008 because of serious ill-health, and although she was found eligible for ESA ? the replacement for incapacity benefit ? she was placed in the work-related activity group, for those expected eventually to return to employment.

She was one of the tens of thousands of disabled people whose contributory form of ESA was stopped from 30 April this year, because of the new one-year time-limit introduced under the coalition?s Welfare Reform Act.

She only found out days before she died that her latest appeal had successfully placed her in the support group for those not expected to carry out any work-related activity, and therefore would no longer be affected by the time-limit.

The disabled activist and blogger Kaliya Franklin has pieced together Sherlock?s experiences from emails and blogs she posted between October 2010 and May 2012.

She wrote in a blog that Sherlock had been filled with ?confusion, fear and anxiety? because of the assessments, appeals and administrative foul-ups she was put through, and that she felt ?caught up in the mill, frustrated, angry and insignificant?.

In a blog on the New Statesman website, fellow disabled activist and blogger Sue Marsh, a friend of Sherlock?s, said she had ?battled just to survive? and faced ?endless pressure, the judgement of society, the fear of destitution, the exhaustion of constant assessments and endless forms?.

Marsh has focused her campaigning efforts on the government?s new one-year time limit, which she describes as ?an emblem of cruelty that really did cross the line of decency?.

She said Sherlock had been ?terrified of the DWP, almost paralysed by a fear that if she spoke out, they would treat her even more harshly. But she spoke out regardless.?

Asked whether Sherlock?s death demonstrated that too many ill and disabled people were being forced through a continuing cycle of assessments and appeals when clearly not fit for work, a spokesman for Chris Grayling, the Conservative minister for employment, said: ?I really don?t think it?s appropriate to comment on an individual case like this.?

Getting a family portrait done is a fantastic way to immortalize a moment in time and to ensure that you always remember your family as they were at that moment in time. It's a brilliant way to decorate the home, a perfect keepsake and something that truly belongs in every family home. However a family portrait is only a good thing if it comes out well, and many people are horrified at the idea of a family portrait precisely because they are concerned about something that looks awkward and cheesy, or about looking bad in the photos. To get a great family portrait you need to spend time planning what you want it to look like and you need to make sure that you have prepared yourself for the picture. At the same time you also need to think about how you are going to pose and the positions you want everyone in. This is something that the photographer will talk through with you, but it certainly helps to know what looks good for you and the kind of position you want. Here are some pointers to help your picture come out looking great. Look at Other Portraits First of all you need to think about how you want the portrait to look in terms of your positions and in terms of your surroundings. This is what will set the tone of the image and have the biggest impact on the eventual outcome. When doing this you need then to make sure that you look at some other portraits for ideas. You can do this in Google images, or by asking a friend, and that way you can present to your photographer an approximation of what you want. Have a Trial Run Having a trial run where you take your family portrait yourself with a digital camera is a very good idea to help you choose what to wear and how to look. You might do your makeup in a certain way, or you might do your hair a certain way, and find that although it looks great in person, it doesn't translate well to film. This way you can experiment ready for the day. Coordinate At the same time you need to consider what other people are wearing when you consider your outfit. If you wear something that you think looks good without first consulting the rest of the family, then you can end up looking very odd indeed and you can end up with a picture where everyone looks casual and you're in a ball gown, or where everyone is in a completely different outfit. Work together on this one and try to coordinate colors too (though not too much which is creepy...). Practice Expressions As well as doing your dress rehearsal you should also practice trying out different expressions which will allow you to ensure you have your most photogenic face on on the day. Some tips are to find your best side, and to angle your head in a way that keeps your jaw defined.

What green rust did to big blue ocean

A rare and highly reactive iron mineral called green rust appears to have played an important role in ancient oceans, suggest new findings, which may have implications for the formation of Earth?s early atmosphere.

The research team identified green rust in an Indonesian lake where conditions mimic those of the ancient oceans, and found the rust played an important role removing an important element, nickel, from the water.

If green rust accomplished something similar in ancient oceans, it could potentially have played an indirect role in the accumulation of oxygen in the atmosphere, a process that picked up speed about 2.3 billion years ago with the first great rise in atmospheric oxygen, called the Great Oxidation Event. The oxygenation of the atmosphere allowed more complex life, including humans, to evolve.

  1. More science news from msnbc.com

    1. Human ancestor ate like a chimp

Science editor Alan Boyle's blog: Researchers use tooth analysis to conclude that a 2 million-year-old human ancestor followed a diet that was more typical for chimps than for early humans.

"The link between green rust, nickel uptake and the oxygenation history of the planet requires further investigation, but our finding is a major step forward," study researcher Simon Poulton, a professor of biogeochemistry at Newcastle University in the United Kingdom, told LiveScience in an email.

Green rust, like the better-known, red-orange stuff, is an iron mineral, first identified only about a decade ago, according to Poulton.

Since then, green rust, which is indeed a pale green, has been found in only a few places, including water-logged soils, groundwater and, now, the oxygen-free water of Lake Matano in Indonesia. The deep waters of this ancient lake contain iron-rich and oxygen-free waters like those scientists believe filled Earth's deep oceans more than 580 million years ago. [ In Living Color: Gallery of Stunning Lakes ]

The discovery of green rust in the lake suggests this rare mineral may have been more common in Earth's ancient past, Poulton said.

Like other iron minerals, green rust readily absorbs dissolved elements onto its surface, but green rust is not only particularly efficient at this ? in many cases, it can also react with toxic dissolved trace metals to make them insoluble, and as a result, renders them in nontoxic forms. This is something most normal iron oxides cannot do, Poulton said.

In the modern world, some hope to use green rust to remove toxic metals and radioactive elements from the environment.

In the ancient oceans, green rust's ability to pull nickel out of the water would have been critical for some life forms, since nickel is an important nutrient for microbes that produce methane. Methane reacts with oxygen to produce carbon dioxide, so less nickel means less methane, which would mean oxygen could remain in the atmosphere and accumulate over time, Poulton explained.

The research has other implications for understanding the composition of ancient oceans. To understand the nutrient composition of the ancient oceans, it's important to know which iron minerals were around at the time. Iron minerals take up dissolved nutrients and carry them to the seafloor, where they eventually become preserved in rock. But because different iron minerals behave differently, scientists must know what iron minerals were present, according to Poulton.

In Lake Matano, they found that green rust played a dominant role in taking up nickel. In the future, Poulton hopes to look into green rust?s interactions with other nutrients.

The research is detailed in the July issue of the journal Geology.

Dancing sunflowers hide their sunlight under Brussels

Debora MacKenzie, contributor

3122_6503_alexandre-dang-2006-cadree.jpg(Image: The Field of Turning Sunflowers by Alexandre Dang)

The point of art is that people should see it, right? When someone announces an exhibition, one assumes one will be able to see the art that has been announced. And so, last week I trotted briskly from my home in Brussels to the nearby Berlaymont building, headquarters of the European Commission, to see The Field of Turning Solar Sunflowers by one Alexandre Dang.

Sadly it was not to be. There was, to be sure, art to be seen at the mega-building known affectionately as the Berlaymonster, including another rather sweet piece by Dang in the building?s sunny entrance hall: a European flag with its twelve stars jiggling about on solar motors, titled ?Europe dancing for joy?. Well, eleven stars were jiggling - one, possibly the financial expert of the group, was not feeling up to it.

But no sunflowers. The man on the reception desk was friendly and apologetic, but sorry - members of the public are not allowed into the space beside the staff restaurant where the flowers were apparently dancing.

By asking nicely and coming back the next day, however, I managed to get signed in for a few minutes to see the show. After all that, they were, I confess, a little underwhelming: a thousand flat cardboard flower shapes in yellow and light brown, which didn?t actually look much like sunflowers, but were all revolving languidly on short wire stalks under a wide skylight, powered by solar motors in their bases.

The overall effect was calming, if not quite as breathtaking as a field of actual sunflowers (which are of course also solar powered). Nor did these pale replicas track the sun across the sky - although, Belgian overcast permitting, they apparently spin faster as it gets sunnier.

The hundreds of Eurocrats who work in the building could see them, of course. We were unable to establish whether the many energy experts in Brussels that week for the conferences of EU Sustainable Energy Week? - one reason the exhibition was there - could get in.

But never mind all that - what impressed me in the end is that this is art that earns its keep. The last day of the exhibition, the flowers were sold off to the Eurocrats at ?15 apiece. A large chunk of the proceeds, via a development charity run by the staff of the EU institutions, will then build solar electricity plants for a school and hospital in Togo, west Africa.

So a lot more practical than your average look-at-me-I?m-on-a-plinth artistic effort, and I can forgive the temporarily quasi-exclusive viewing - especially because, it turns out, similar Solar Flowers form a component of other exhibitions

(AP) ? Nora Ephron, the essayist, author and filmmaker who thrived in the male-dominated worlds of movies and journalism, has died. She was 71.

She died of leukemia Tuesday night at New York Presbyterian/Weill Cornell Medical Center, her family said in a statement.

"She was so, so alive," said her friend Carrie Fisher. "It makes no sense to me that she isn't alive anymore."

Born into a family of screenwriters, Ephron was a top journalist in her 20s and 30s, then a best-selling author and successful director. Loved, respected and feared for her devastating and diverting wit, she was among the most quotable and influential writers of her generation.

She wrote and directed such favorites as "Julie & Julia" and "Sleepless in Seattle," and her books included the novel "Heartburn," a roman a clef about her marriage to Washington Post reporter Carl Bernstein; and the popular essay collections "I Feel Bad About My Neck" and "I Remember Nothing."

She was tough on others ? Bernstein's marital transgressions were immortalized in "Heartburn" ? and relentless about herself. She wrote openly about her difficult childhood, her failed relationships, her doubts about her physical appearance and the hated intrusion of age.

Even within the smart-talking axis of New York-Washington-Los Angeles, no one bettered Ephron, slender and dark-haired, her bright and pointed smile like a one-liner made flesh. Friends from Mike Nichols and Meryl Streep to Calvin Trillin and Pete Hamill adored her for her wisdom, her loyalty and turns of phrase.

As a screenwriter, Ephron was nominated three times for Academy Awards, for "Silkwood," ''When Harry Met Sally ..." and "Sleepless in Seattle," and was the rare woman to write, direct and produce Hollywood movies. Fisher and Meg Ryan were among the many actresses who said they loved working with Ephron because she understood them so much better than did her male peers.

"I suppose you could say Nora was my ideal," Fisher said. "In a world where we're told that you can't have it all, Nora consistently proved that adage wrong. A writer, director, wife, mother, chef, wit ? there didn't seem to be anything she couldn't do."

"Sleepless in Seattle" star Tom Hanks said Ephron "knew what was important to know; how things really worked, what was worthwhile, who was fascinating and why."

The eldest of four children, Ephron was born in New York to screenwriters Harry and Phoebe Ephron, who moved to Beverly Hills, Calif., when she was 4 years old.

Regular visitors included "Casablanca" co-writer Julius J. Epstein, "Sunset Boulevard" collaborator Charles Brackett, and the team of Albert Hackett and Frances Goodrich, who worked on "The Thin Man" and "It's a Wonderful Life."

Determined by high school to be a journalist, Ephron graduated from the single-sex Wellesley College in 1962, moved to New York and started out as a "mail girl" and fact checker at Newsweek. A newspaper strike at the end of the year gave her a chance. Victor Navasky, the future editor of The Nation, was then running a satirical magazine called the Monacle. He was working on a parody of the New York Post, "The New York Pest," and asked Ephron for a spoof of Post columnist Leonard Lyons.

She succeeded so well that the newspaper's publisher, Dorothy Schiff, reasoned that anyone who could make fun of the Post could also write for it. Ephron was asked to try out as a reporter. Within a week, she had a permanent job and remained there five years.

Ephron began writing for Esquire and The New York Times and developed a national following as a throwback to the prime of Dorothy Parker and S.J. Perelman and a worthy peer of such new and hip journalists as Gay Talese and Tom Wolfe. Part of her gift was her fresh takes on such traditional subjects for women as food and fashion.

By the 1970s, she had met Bernstein, who teamed with fellow Washington Post reporter Bob Woodward on prize-winning coverage of the Watergate scandal that brought down President Richard Nixon. They married in 1976, and had two children, but love soon turned to hate ? and matured into art. Ephron was pregnant with their second child when she learned Bernstein was having an affair.

She wrote "Heartburn," later a film starring Streep and Jack Nicholson and directed by Nichols, with whom she collaborated often. The book was so close to her life that Bernstein threatened to sue.

Another perk from her time with Bernstein: She sussed out that "Deep Throat," the unnamed and unknown Watergate source, was in fact FBI official Mark Felt. She would allege that she told countless people about Felt, who did not acknowledge his role until years later.

Her screenwriting credits included "Heartburn," the nuclear power drama "Silkwood" and the romantic comedy "When Harry Met Sally ..." She twice directed the team of Ryan and Hanks, in "Sleepless in Seattle" and "You've Got Mail," and also worked with John Travolta (in the fantasy "Michael"), Steve Martin ("Mixed Nuts") and Nicole Kidman ("Bewitched").

Ephron was married three times: to Dan Greenburg, Bernstein and to "Wiseguys" author Nicholas Pileggi, whose book was adapted into the Martin Scorsese film "Goodfellas." Sisters Delia, Amy and Hallie Ephron also are writers and Nora and Delia collaborated on such films as "This Is My Life" and "Sleepless in Seattle."

(AP) ? Natalia Guzman stepped hesitantly into the morgue looking for her only son. She was led to rows of refrigeration units, where after peering at more than a dozen corpses she finally found 17-year-old Jaime.

Trembling and in tears, she embraced relatives outside the building and said her son's body had been riddled with bullets. She blamed a drug-dealing gang in her slum for the killing and complained that police might have prevented it had they been patrolling her neighborhood.

The rising tide of violent crime that has engulfed Venezuela has become a top issue in the country's presidential campaign, with opposition candidate Henrique Capriles blaming President Hugo Chavez's government for failing to halt the bloodshed. Yet Guzman and many other Venezuelans appear to have lost faith in the ability of any government as well as the police to address the problem, no matter who wins the October vote.

"Crime is out of control, and I don't think any politician, neither Chavez, nor Capriles, is going to change that," Guzman said, speaking in a low voice that at times cracked when she cried.

The government says more than 14,000 people were killed in Venezuela last year, giving the country a murder rate of 50 per 100,000 people and making it one of the most violent countries in Latin America and the world. The murder rate has more than doubled since 1998, when Chavez was first elected.

At campaign rallies, Capriles has been promising to fix what he calls one of Chavez's most glaring failures, declaring: "We will have to choose between life or death."

Chavez has responded by banning gun sales, expanding a new national police force and launching an anti-crime plan with stepped-up policing and other programs in high-crime areas.

It's unclear how the political tug-of-war on crime may affect the race. But Chavez's opponents are hammering away on the issue, convinced that some voters will be swayed.

Capriles' campaign manager, Leopoldo Lopez, said as he presented the opposition's "Security for All" anti-crime plan that nearly 14 years after Chavez was first elected, the president's promises are too little, too late. "He's never made the issue of security a priority, until now when he tries to use it as a political banner," Lopez said.

Experts say violent crime has increased in the country due to easy, cheap access to guns, a culture of violence among young men in the slums, and severe shortages of police officers and prosecutors.

Criminologist Fermin Marmol Garcia said Venezuela's fundamental problem is that for more than a decade, "the institutions that weigh heavily on crime prevention and suppression were not strengthened."

In polls, Venezuelans consistently rate violent crime as their top concern. But many tend to blame long-standing institutional problems such as police forces viewed as corrupt and incapable, rather than pointing fingers at politicians.

"For Capriles, the challenge is putting the issue on the pedestal, linking it directly to Chavez, showing that he's responsible and creating hope that it's possible to solve the problem," said Luis Vicente Leon, a Caracas-based pollster and political analyst. He said Capriles, who has been trailing in the polls, hasn't yet been able to gain traction on the issue.

Guzman isn't committed to either presidential candidate, and so far Capriles' anti-crime message hasn't resonated with her.

She said her son's motorcycle was stolen when he was killed after a street party, and she suspects the gunmen who killed him are the same toughs who terrorize her neighborhood.

"The police are almost never around when there's a problem. They always arrive hours afterward and they never capture anybody," Guzman said. "It's the thugs, not the police, who control the neighborhoods."

The authorities say a majority of the country's killings involve young men, often battling in poor neighborhoods over turf or drug dealing, or in simple rivalries. Crime has also been expanding into places once seen as safe, such as movie theaters, shopping malls and parking garages where security guards stand watch.

Shooting victims are often brought to the Perez de Leon Hospital near Petare, Venezuela's largest slum, where Guzman's son was gunned down. At the hospital, janitors mop blood from the white tile floor while doctors scramble to save lives. The victims' friends and relatives anxiously wait outside the emergency ward.

Abductions for ransom have grown rapidly in the past decade, with kidnapping reported to police rising from 52 in 1998, when Chavez was first elected, to 618 in 2009. Security experts say the real number of kidnappings is much higher because most cases aren't reported to authorities.

Recently diplomats from Costa Rica, Mexico and Chile were kidnapped, and all were eventually freed after ordeals lasting from two hours to more than a day.

Among the middle and upper classes, growing numbers of Venezuelans have been trying to take their security into their own hands by enrolling in self-defense courses, hiring bodyguards or bulletproofing their vehicles.

"Business has multiplied," said Ernesto Carrera, director of the School of Personal Protection, which offers intensive self-defense courses. He said his clientele has grown by about 80 percent in the past five years.

Jose Berrios, a 34-year-old businessman, decided to enroll after surviving an armed robbery, and now spends three nights a week at the school learning self-defense techniques and struggling through exercise sessions that include tossing medicine balls, doing pull-ups and lifting weights.

In one training session, an instructor demonstrated how to avoid a carjacking by using a martial arts move to disarm an attacker.

Capriles has been trying to capitalize on Venezuelans' concerns by accusing Chavez of ignoring the issue for most of his presidency. He has promised to take a different approach and make crime-fighting a top priority, laying out a plan that includes putting more police on the streets, raising officers' salaries and bringing more sports and art programs to poor neighborhoods.

Chavez responded by launching his latest anti-crime program last week, dubbed the "Great Mission For Every Life Venezuela." It includes allocating more money to expand training programs for police, starting community programs for troubled youth, expanding a fledgling national police force and targeting law enforcement resources to high-crime areas.

Justice Minister Tareck El Aissami said the country now has about 92,000 police officers in a patchwork of state, local and national police force but acknowledged Venezuela would need about 20,000 more police officers to meet U.N. standards. This September, El Aissami said, about 9,500 new recruits are scheduled to join the Bolivarian National Police after they undergo training.

El Aissami said that the challenge of combatting violence goes beyond hiring more police and building more prisons. Part of the government's program, he said, focuses on giving young men in the slums alternatives through sports and community programs so that they no longer view "a pistol and a motorcycle" as status symbols.

El Aissami told reporters last week that crime "is the most serious problem, the one of greatest concern and the one of greatest attention for the government."

Why U.S. Communications Law is Obsolete | rip and reader ...

The problem is obsolete analog law obstructs our modern digital world.

Amazingly, America?s core communications law still rests upon the technological limitations and monopoly economic assumptions of early twentieth century analog telephones and one-way analog AM radio transmissions, as if the digital revolution of the computer, broadband, smart phones, WiFi and the Internet never happened. Only in Government, which habitually adds without subtracting, could such obsolete ideas, notions and assumptions obliviously blob along in near complete contradiction to the world around them.

The old adage is true here, that if you only have a hammer everything looks like a nail. Well if you have communications laws still predicated on 1880?s railroad regulation, 1927 radio capabilities and 1934 economics, everything looks like it needs centralized government control and regulation.

At core, America?s communications law wrongly assumes technologically and economically that Americans have, and should have, one common analog electronic form of communicating ? a telephone, and one common analog electronic way of receiving information ? AM radio broadcasts. The obsolete technological and economic assumptions of these early 1900s technologies are now completely divorced from the reality of America?s fiercely competitive digital communications marketplace. Nevertheless, they still legally rule the analog remnants of American communications and still jealously entangle and impede the progress of modern digital communications.

To understand the absurdity of our obsolete core communications law, imagine if our transportation law still permanently assumed that the capabilities and economics of a horse and buggy should be the baseline for regulation of all modern transportation technologies that follow. ?Wisely Congress modernized transportation law in the 1970s and 1980s, and finally abolished the obsolete Interstate Commerce Commission in 1995.

Today digital communication does not limit consumers to an analog telephone call of yesteryear, but offers them a panoply of digital choices of a: voice call, text, email, chat, instant message, voicemail, video chat, video call, video conference, VoIP, Skype, BBM, AIM, iChat, FaceTime, Twitter, Facebook messaging, Hangout, etc. Nor are consumers limited to just AM radio of yesteryear, but enjoy a smorgasbord of choice of AM radio, FM radio, satellite radio, HD radio, TV broadcast, HDTV broadcast, cable, direct broadcast satellite, the Internet, DSL, cable modem, fiber-to-the-home, wireless broadband, WiFi, WiMax, LTE, video streaming, YouTube, Hulu, TiVo, etc. Today?s digital reality of expansive competitive choice mocks the archaic monopoly assumptions of our stubbornly obsolete communications law.

So why are analog electronic technological and economic assumptions obsolete, if we still use analog telephones and AM radios today?

First, analog telephone technology suffers from static ?natural monopoly? economics, whereas digital communications technology enjoys natural competitive economics because the dynamic of digital technology continuously generates more capabilities and capacity at lower cost, which eliminates barriers to entry, fuels innovation, and encourages risk capital investment.

Analog telephone circuits allow only one conversation, while digital communications enable ever increasing multiples of conversations on the same facility or spectrum. Unlike the real physical limits of analog telephones and AM radios, digital communication technology has virtually limitless capabilities, and vastly better and constantly-improving economics because of Moore?s Law (the doubling of microchip performance every ~two years); Coopers Law (the doubling of radio spectrum utilization efficiency every ~30 months); and optimization algorithms (which continuously maximize transmission capacity, like Cable DOCSIS, wireless broadband LTE, and a wide variety of audio and video compression standards.)

Second, digital communications? natural competitive economics fuel competition and opportunity, which in turn empowers the consumer to choose whatever communication method they want at any given time or circumstance to meet their varied purposes, needs, wants and means. This natural competitive dynamic makes obsolete the notion in our law that Government regulators must approve what technologies, products or services are allowed to be sold to the public at what price, terms or conditions.

In sum, obsolete law is a drag on progress, because it discourages innovation and investment by assuming regulation is necessary when it is not, which in turn causes unnecessary inefficiency, long-delays, dead-weight costs and artificial uncertainty. Consider: the cell phone was invented in 1947, but not approved for commercial use until 1982; Internet packet-switching technology was invented in 1969, but not commercialized until the early 1990s; and computer modems were invented in the 1950s but not commercialized for broadband until after 2000.

American communications policy obsolescence is an unnecessary drag on everything it touches. The solution is simple ? modernize America?s obsolete communications law.
