Occupy Movement Heading Into Vacant Homes | Delaware Real ...

The Occupy Movement in Oakland has been on the ?cutting edge? of media with how it has been handled by the local police. However, recently the movement voted to move its occupation into vacant houses in the Oakland Bay area according to DS News.

Occupy Oakland recently began pushing for protestors to take up in vacant locations around the Bay Area. Is Columbus next?

Of course, the movement isn?t the first to push for a greater-use of vacant buildings. However, the violance associated with the Occupy Movement in the Bay Area does make its decision one that could be the most volotile.

Just across the bay, in San Francisco ?Homes Not Jails? has been making strides to put homeless into vacant buildings since 1992. Since 2006, Ohio congresswoman Marcy Kaptur, representing the Toledo area, has been advocating that homeowners remain in their home throughout the foreclosure process and even after the foreclosure was completed.

The Problem With Their Plan

Who is going to pay for the damage that the occupy movement causes to these vacant properties? Or will the owner just ignore it more, hence, adding to the blight that they are fighting against?

If there was a rental agreement ? even if only for $1 a year ? in place it would lay out the legal rights and obligations for each side. However, without that agreement the situation is tenous at best.

Problems for the Organizers

  • Subject to trespassing and breaking and entering violations (of course is based on local rules)
  • Get hurt? There is absolutely no insurance that will cover a person getting hurt while on another?s property illegally.

Problems for the Building Owners

  • Can?t rent this building or nearby building while the occupy movement is in the area
  • Cost to repair the building when the occupiers leave
  • Concerns about lawsuits from people being hurt while on their property.

What?s the final outcome? We?ll have to watch and see how all this plays out but it looks like a lose-lose for everyone involved ? well except the lawyers.
